Terms of Service

By accessing or using the services provided by AVANX, you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions of this agreement, you should not access our website or use any of our services.

AVANX provides creator commerce, TikTok Shop growth, live commerce management, and affiliate ecosystem strategy services. All services are subject to specific statements of work (SOW) or service agreements between AVANX and the Client.

You agree to provide accurate, current, and complete information as may be prompted by any registration forms on the site. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

The content on our site, including text, graphics, logos, and software, is the property of AVANX and is protected by copyright and other laws. Clients retain ownership of their brand materials, while AVANX retains ownership of its proprietary methodologies and internal tools used during service delivery.

To the maximum extent permitted by law, AVANX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of our services.

You agree to indemnify and hold harmless AVANX and its officers, directors, employees, and agents from any claims, suits, or actions arising from your violation of these Terms or your use of the services in a manner not authorized by AVANX.

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the services will immediately cease.

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any dispute arising from these terms will first be addressed through good faith negotiation. If unresolved, the dispute shall be submitted to binding arbitration in the County of Los Angeles, California.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
